Welcome to Creavanzi Studio - Kimberly Vanzi. These Terms and Conditions ("Terms") govern the use of our services, including consultation scheduling, website design, branding, marketing, and localization. By scheduling a consultation or engaging in our services, you agree to these Terms. Please read them carefully before proceeding.

Consultation Booking & Evaluation

  • All consultations must be booked in advance to determine the scope of services needed.

  • After booking, communication via email or other methods will be used to assess whether a consultation is required or if services can proceed directly.

  • If a consultation is deemed necessary, an invoice will be issued, and payment must be made before the consultation begins.

  • Payment will be made via a SumUp payment link, which will be provided in the invoice.

  • If payment is not received within 3 days of receiving the invoice, the consultation slot may be released. However, if the consultation is scheduled within the next 48 hours, payment must be completed immediately upon receiving the invoice to secure the booking.

  • Failure to complete payment before the consultation may result in automatic cancellation.

Cancellations & Rescheduling

  • You may reschedule or cancel a consultation with at least 24 hours’ notice.

  • No refunds will be issued for cancellations made less than 24 hours before the scheduled time.

  • If you miss your scheduled consultation without notice, a new payment will be required to rebook.

  • If an issue on our end prevents the consultation from happening, we will work with you to reschedule or issue a refund.

Refunds & Non-Payment

  • Consultation fees are non-refundable, except in cases where we are unable to provide the service due to unforeseen circumstances.

  • If payment is not received within 3 days of receiving the invoice, the consultation slot may be released. For consultations scheduled within the next 48 hours, payment must be completed immediately to confirm the booking.

  • For other services such as website design, branding, and marketing, payment terms will be outlined in a separate contract or agreement.

Services & Payment Terms for Custom Work

  • Custom services such as website design, branding, marketing, and localization require a formal agreement outlining the project scope, pricing, and timelines.

  • A non-refundable deposit may be required before work begins, as specified in your contract.

  • Full payment is due upon project completion unless otherwise agreed.

  • If a client terminates a project mid-way, they are responsible for all work completed up to that point.

Intellectual Property & Ownership

  • Upon full payment, clients receive the agreed-upon rights to use website designs, branding materials, and marketing content.

  • Creavanzi Studio reserves the right to use completed projects in its portfolio or promotional materials, unless otherwise agreed.

Limitation of Liability

  • Creavanzi Studio provides design and marketing services to enhance your brand, but we cannot guarantee specific business outcomes.

  • We are not responsible for third-party software issues, website hosting failures, or search engine algorithm changes affecting SEO performance.

  • Clients are responsible for reviewing and approving all work before implementation.

If you become a client, I may collect the information needed to discuss, arrange, and deliver services. This may include project information, files, messages, meeting notes, and other communications connected to your inquiry or project.

For invoicing and payment purposes, I may collect your name, business name, business address, email address, telephone number, Partita IVA/VAT number where applicable, codice fiscale where legally required, invoice details, and payment records.

If you subscribe to the Creavanzi newsletter, I collect your email address and any subscription preferences you provide. I may also collect technical and usage information where you accept Analytics cookies through the website’s cookie settings.

If you choose to contact me through WhatsApp, I may receive the information you voluntarily provide through that service, such as your phone number, profile information, and messages.

04

How I Use Your Information

I use your contact and inquiry information to respond to you, understand the services you are interested in, discuss your needs, prepare a proposal or quote where appropriate, and arrange an agreed project.

If you engage my services, I use the information and project materials you provide to carry out the agreed work. This may include completing a Digital Presence Review, preparing findings and recommendations, delivering a final report, supporting implementation, and providing agreed ongoing maintenance or related services.

Where project materials include personal data about other individuals, such as your customers, members, employees, or website users, I use that information only where necessary to provide the agreed services, in accordance with your instructions and any applicable agreement.

I use client, invoicing, and payment information to issue invoices, send a SumUp payment link via email when card payments are available, record payments, manage client accounts, and meet Italian accounting and tax obligations. Bank transfer may also be available as a payment method.

I may also use information to communicate with you about an active project, provide relevant service updates, maintain appropriate business records, protect the security and functionality of my website and services, and send the Creavanzi newsletter to which you have subscribed.

05

Client Project Materials

Clients should provide only the information needed for the agreed work.

Where a client provides personal data about their customers, members, employees, or other contacts, I use that information only as necessary to deliver the agreed services and in accordance with the client’s instructions.

The client remains responsible for ensuring they have the appropriate right to share that information, including consent or another appropriate lawful basis where required, and for providing any privacy information required to the people concerned. Depending on the work involved, separate data-processing terms may be agreed.

06

Applicable Data Protection Laws

Creavanzi – Kimberly Vanzi is established in Italy and processes personal data in accordance with the EU General Data Protection Regulation (“GDPR”), Regulation (EU) 2016/679, together with applicable Italian data-protection law.

As I work with clients and website visitors internationally, additional data-protection laws may apply in specific circumstances, depending on the nature of the services, the type of personal data involved, and the location of the individual concerned. Where applicable, I will handle personal information and privacy requests in accordance with those requirements.

This Privacy & Cookie Policy is intended to provide information required under Articles 13 and 14 of the GDPR.

07

Legal Bases for Processing (GDPR Article 6)

I process personal data under one or more of the following legal bases:

  • Consent — for newsletter subscriptions and optional cookie categories, including Functional and Analytics cookies, where you make that choice through the website’s cookie-consent settings.

  • Performance of a contract or steps requested before entering a contract — when you contact me about services, request a proposal, engage my services, or ask me to carry out a review, implementation, maintenance, or related work.

  • Legitimate interests — to respond to professional inquiries, communicate about an active project, maintain appropriate business records, protect the security and functionality of my website and services, and follow up on important service communications where appropriate.

  • Legal obligation — where processing or retention is required for invoicing, accounting, tax, or other legal obligations.

You may withdraw consent at any time. This does not affect processing carried out before withdrawal.

08

Newsletter

The Creavanzi newsletter is managed through Wix. I use your email address to send the newsletter only when you choose to subscribe. Every newsletter includes an unsubscribe link, and you may unsubscribe at any time.

My LinkedIn newsletter is hosted by LinkedIn and is separate from the Creavanzi website newsletter. I do not add LinkedIn newsletter subscribers to my Wix newsletter list unless they separately subscribe.

09

Cookies and consent preferences

This website uses Cookie Banner by Consentik CMP to manage cookie choices and consent preferences. Essential cookies are used to operate the website and remember cookie choices. You can accept, decline, or manage non-essential categories when you first visit the website, and you can change or withdraw your choices at any time through the Manage cookies link available on the website.

Essential cookies

Essential cookies support functions such as website security, accessibility, network management, and the saving of cookie-consent preferences. They are necessary for the website to function properly and cannot normally be switched off through the cookie banner.

Functional cookies

Functional cookies may be used to remember choices or settings that improve your experience, such as language preferences or optional Wix features. They are used only where the related feature is active, and you have enabled this category.

Analytics cookies

Where you accept Analytics cookies, this website may use Google Analytics, configured through Wix Studio, to understand how visitors use the website. This may include pages viewed, time spent on pages, browser or device information, and general interaction data. Analytics information is used to improve website performance and user experience.

Advertising cookies

Creavanzi does not currently use advertising or remarketing cookies on this website. If this changes, the cookie banner and this policy will be updated before those technologies are used.

This website is accessible internationally. Cookie choices may be presented differently depending on your approximate location and the legal requirements that apply to your visit.

Where opt-in consent is required, non-essential cookies and similar technologies are not activated until you make a choice through the cookie banner. In regions that use an opt-out model, the banner may present different choices, including the ability to opt out of certain processing.

The cookie categories and options shown to you reflect the consent configuration applicable to your visit.

10

Email tracking

I use MailSuite with Gmail/Google Workspace for business email tracking. Where tracking is enabled, MailSuite may record whether an email has been opened and whether a tracked link has been clicked. This information is used in a limited way to understand whether an important business or service communication has been received and whether follow-up may be appropriate.

I do not use email-tracking information to make automated decisions about you. If you prefer not to receive tracked emails, contact me at legal@creavanzi.com.

11

 Wix Members, Groups and Spaces

If you choose to use Wix Members, Groups, or Spaces features available on the site, Wix may process account, profile, login, and activity information needed for those features. Any profile information or content you choose to make public through those features may be visible to other users in line with the settings you select.

12

International transfers

Some service providers may process or store data outside the European Economic Area. Where required, transfers are made using safeguards recognized under applicable data-protection law, such as an adequacy decision or Standard Contractual Clauses.

13

Data Retention

I keep personal data only for as long as necessary for the purpose for which it was collected. Inquiry and communication records are retained only as long as needed to respond, follow up, and protect legitimate business interests.

Client and project records are retained as needed to provide services and manage the client relationship. Invoice and accounting records are retained for the period required by applicable Italian tax and civil-law obligations.

Newsletter information is retained until you unsubscribe, subject to retaining only the minimum information needed to honor that choice. Analytics retention is determined by the settings configured in the relevant service.

14

Third-Party Services

We rely on a small number of trusted third-party tools to run our business. These may include hosting providers, analytics platforms, email services, and scheduling or payment processors.

Each provider is selected for its commitment to data security and privacy. They only access the information needed to perform their specific function and are not permitted to use it for their own purposes.

15

Your Rights

Subject to applicable law, you may request access to your personal data, correction of inaccurate data, deletion, restriction of processing, objection to processing based on legitimate interest, data portability where applicable, or withdrawal of consent.

To exercise your rights, contact legal@creavanzi.com. You may also lodge a complaint with the Italian Data Protection Authority, the Garante per la protezione dei dati personali.

16

Children’s Privacy

Creavanzi’s services are intended for business owners and professionals and are not directed to children.

17

Changes to this Policy

I may update this Privacy & Cookie Policy when my services, website tools, or legal requirements change. The current version will always be available on this page, along with its last update date.
